Getting Started
By purchasing any paid plan or feature on Cactusian, you agree to be bound by these Terms in full. These Terms apply to all one-time feature purchases and recurring subscription plans available on the Cactusian website or app. We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. Continued use of Cactusian following any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.Types of Purchases
Digital Goods:
- One-Time Feature Purchases: A single payment grants you permanent or limited-time access to a specific feature or upgrade within Cactusian. No physical product or downloadable file is provided.
- Subscription Plans: A recurring payment grants you ongoing access to a set of features or a tier of Cactusian for the duration of your active subscription.
Account Responsibility
You are solely responsible for maintaining the confidentiality of your Cactusian account credentials and for all activity that occurs under your account. If you suspect unauthorized access to your account, you must notify us immediately. Cactusian is not liable for any loss or damage arising from unauthorized use of your account. Account suspension, moderation or termination does not entitle you to any refund, credit, or extension of access.Payment Terms
One-Time Purchases
Payment is due in full at the time of purchase. Access to the purchased feature will be activated upon confirmation of payment. All prices are displayed in the currency shown at checkout on Cactusian and may be subject to applicable taxes depending on your location.Subscriptions
Subscription fees are billed on a recurring basis (weekly, monthly, or annually, depending on your chosen Cactusian plan) and will be automatically charged to your payment method on file at the start of each billing cycle. By subscribing, you authorize Cactusian to charge your payment method until you cancel. Prices are subject to change. We will provide reasonable notice before any price changes take effect. Continued use of your Cactusian subscription after a price change constitutes acceptance of the new pricing.Taxes
You are responsible for any applicable taxes, levies, or duties imposed by your local jurisdiction in connection with your Cactusian purchases. Where required by law, we may collect and remit such taxes on your behalf. The displayed price at checkout may or may not include taxes depending on your location.Non-Payment & Suspension
If a payment fails or is not received by the due date, Cactusian reserves the right to immediately suspend your access to any subscription features or one-time purchased features tied to your account.Cancellations
One-Time Feature Purchases
All one-time feature purchases on Cactusian are final. Once access has been activated, no cancellation or refund will be issued unless otherwise stated in our Refund Policy.Subscriptions
You may cancel your Cactusian subscription at any time through your account settings. Your cancellation will take effect at the end of the current billing period, you will retain access until then and will not be charged for the next cycle. No refunds or prorated credits are issued for unused time within an active billing period. Cactusian reserves the right to cancel or terminate any subscription at any time for any reason, at our sole discretion, including in cases of suspected misuse, abuse, or violation of these Terms.Fair Use & Abuse
Cactusian’s services and platforms are intended for personal or business use in good faith. We reserve the right to monitor usage and take action, including suspension or termination, against any account that we determine, at our sole discretion, is engaging in abusive, fraudulent, or unreasonable use of Cactusian or its features.Feature Availability & Changes
Cactusian reserves the right to modify, limit, or discontinue any feature, including those you have paid for, at any time and at our sole discretion. We will make reasonable efforts to notify users of significant changes, but we do not guarantee the permanent availability of any feature, pricing, or functionality on Cactusian. No refunds will be issued as a result of feature changes or removals unless required by applicable law.Chargebacks & Disputes
We strongly encourage you to contact us before initiating a dispute with your bank or payment provider. If a chargeback is filed against a purchase, we reserve the right to immediately and permanently terminate your account and access to all associated digital products, without notice or refund. We will also dispute and fight the chargeback and provide all relevant transaction records to the payment provider. Accounts terminated due to a chargeback will not be reinstated.Disclaimers
Cactusian and all its features are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the reliability, accuracy, or fitness for a particular purpose of any feature or service. Cactusian does not guarantee uninterrupted access and shall not be held liable for any downtime, data loss, or service interruptions beyond our reasonable control.Limitation of Liability
To the fullest extent permitted by law, Cactusian shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to access Cactusian or its features. Our total liability shall not exceed the amount paid by you in the 30 days preceding the event giving rise to the claim.Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the state of California, without regard to its conflict of law principles.Contact
